I am an aspiring writer, and have been for years, and I just recently had an original idea that does not copy Tolkien. But even looking at my notes now, I can see how Tolkien has influenced me on a subconcious level.

It has been a struggle to stay away from the Lord of the Rings fantasy world, and I can see how many authors can slip, or even cash in on the popularity of that sort of setting.

That happened recently with a book I shall not name for fear of being flamed. But it has more direct relations to Tolkien's respective works than I have ever see. I get so angry with that peice of work.
