Do you think that the Tracker was important enough to have an elvish spirit? He certainly acted independently in his speech and in shooting the Uruk.
I would think that a lowly tracker would not be important enough to have such a spirit. As a matter of fact I think that giving such a lowly peon a soul could be a disadavantage. To me this tends to show that lower level orcs could, and did, act independently.
